DESIGN STANDARDS FOR LIBERTY SQUARE SUBDIVISION

December 2007

 

PURPOSE
These design standards have been established by the Architectural Control Committee (ACC) in order to create and maintain a community of high esteem and visual harmony.  Design standards govern the architectural control requests made by residents and are not arbitrary.  In the event of a conflict between the Declaration of Covenants for your community and the Design Standards, the covenants shall prevail.

 

ARCHITECTURAL CONTROL REQUEST PROCEDURE
Any addition, alteration or change of any kind to the exterior of your home or lot requires written approval, in advance.  Requests for all projects must be made, in writing, to the ACC in care of:

All ACC requests must include the following:

 

1.     A site plan of your property (received at closing) showing the location of your addition or alteration.

2.     A full description of your project, including dimensions, colors and materials used.

 

The Architectural Control Committee will respond to your request within thirty (30) days from the date of receipt by the committee.

 

Below are the Design Standards, which have been adopted by your community.

 

FENCING
·       No chain link or Cyclone Fences may be placed on the property. The Architectural Control Committee must approve all fences.

·       Material of fence must be of pressure treated natural wood

·       Only a picket style fence will be allowed. Only exception will be for the town homes, see town homes section.

·       Color of fence must be white or natural wood. Fence in front of home must be white.

·       When a front fence already exists, the adding of a side or back fence must be constructed to match the front fence as close as possible: as in color, size of the picket, space between the picket, etc.

·       The pickets or boards can range in size from 3” to 4” in width. The space between the pickets may range from 2” to 3 ½”.

·       Fence around property footprint may not be more than 48” in height and no lower than 36” in height.

·       Fence must have entry to property, gated or open. If gated, gate must match that of fence style.

 

TOWN HOMES FENCING
·       Only town homes will be approved for a privacy fence to separate adjoining patios.

·       The privacy fence is not to be used to completely enclose the patio.

·       Privacy fence cannot exceed footprint of town home or patio.

·       Privacy fence may not be more than 6’ in height.

·       Privacy fence of patio must be one sided.

·       Fence must be of pressure treated natural wood. Color may be natural or white.

See Article VIII, Section 5 of the Covenants.

 

LANDSCAPING
Any addition or alteration to a lot which may affect the appearance of such Lot or which affects or alters the natural flow of surface water from the Lot requires approval in advance from the ACC. In addition, except as provided in Article VI, Section 1 of the Covenants, all maintenance of the Lot and all structures, parking areas, fencing, landscaping not conducted by the association, and all other improvements thereon shall be the sole responsibility of the owner thereof, who shall maintain such lot in a manner consistent with The Declaration of Covenants, Conditions and Restrictions for Liberty Square Subdivision.

 

STATUARY
No artificial vegetation shall be permitted on the exterior of any property.  Exterior sculptures, fountains, flags, etc., must be approved in advance.

 

GARDENS AND PLAY EQUIPMENT
Vegetable gardens, hammocks or play equipment must be located between the rear of the dwelling and the rear lot line. The exact location of play equipment including, without limitation, basketball goals, must be approved in advance.

 

ANTENNAS & SATELLITE DISHES
See Article VIII, Section 14 of the Covenants. Must have ACC approval.

 

CLOTHESLINES/GARBAGE CANS/WOODPILES
Garbage cans, woodpiles, and other similar items shall be located or screened so as to be as concealed from view as possible from neighboring lots, streets and adjacent property.  Clotheslines are not permitted.

 

EXTERIOR LIGHTING
Colored lights shall not be used except those decorative holiday lights and ornamentation used during the holiday season from Halloween through New Years Day. Landscape lighting must be approved in advance. Holiday decorations must also be taken down within two weeks after the holiday.

 

EXTERIOR COLORS

As the exterior of homes need repairing, any change from the original color scheme must be approved in advance. The request submittal should include color chips for the ACC review. Repainting in the same color does not require ACC approval.

 

PENALTIES

Any resident who is found to be in violation of the Declaration of Covenants, Conditions and Restrictions and these Architectural Guidelines, Appearance and Design Standards is subject to penalties according to the following schedule:

·       Failure to apply for ACC approval of a project             Up to $200.00 fine

·       First Notice including cease and desist                                   Warning Letter

·       Second Notice of the same violation                          Fine of $10 per day

·       Third Notice                                                                Right of Abatement

·       Failure to pay assessed penalty and/or costs attributed to Right of Abatement                                   Property Lien

 

 

These Architectural Guidelines, Appearance and Design Standards Supersede any Previous Standards.
